Landon Cassill is suing BK Racing for unpaid winnings and other fees owed to him after he drove for the team in the 2012 season. Cassill was told in mid-January that he would not return as a driver for the second-year team.

A lawsuit was filed last month in North Carolina Superior Court in Charlotte against BK Racing and owner Ron Devine.

“I really hated to go the legal route but at the end of the day I’m ultimately asking to be paid what I earned last season,” Cassill said in a statement. “I was excited to race for BK in 2013 and was disappointed when my contract was not renewed for this season.”

In the lawsuit, it is stated that a performance-based clause in his contract included a minimum payout of $500,000. After the season was over, his earned $355,000 of that. Cassill claims that he is still owed $145,000.

David Reutimann replaced Cassill in the No. 83 BK Racing entry. Cassill moved onto a part time ride with Joe Falk in the No. 33 Chevrolet. The No. 33 entry is shared with Richard Childress Racing.
